RENTAL POLICIES AND DAMAGE SECURITY AGREEMENT
Please take a moment to read the following important information.
Contact information. Our on-site office is generally open 9 am to 5 pm cst daily. We are located at 660 Nautilus Ct., Fort Walton Beach, Florida 32548. We may be contacted via telephone at 850-244-9860, via text at 850-695-8582 or via email at nautiluscondominiumsgm@gmail.com. If you require after-hours emergency assistance (Ex: AC/Heat not working or a water leak), contact us via telephone at 850-244-9860 and our after hours answering service will contact staff.
Payment and Cancellation Policy for booking direct through Nautilus Condominiums – If you booked through an online travel agent (AirBNB, VRBO, etc), the payment and cancellation policy of the platform applies. A $250 advance payment is required at the time of booking for a reservation to be valid. The final balance is due 30 days prior to check-in. If we have not received another form of payment prior to your due date, your credit card will be charged automatically. The cancellation of rentals that are made more than 30 days prior to the arrival date will forfeit $250. If you cancel within 30 days of your arrival, you will forfeit 100% of the total reservation amount. If the renter must shorten their stay within 30 days of arrival or after checked in, no refunds will be provided for the nights not used. Once you are within 30 days of checking in there are no moving dates, nor moving units. Long term renter (28 days or longer) – must pay 1st months rent 60 days prior to arrival and must cancel at least 60 days prior to arrival or will forfeit 100% of total reservation amount. For long term renters within 60 days of arrival – there is no shortening their entire stay, nor moving dates, nor moving units. We encourage guests to buy Travel Protection Insurance to protect themselves. No refunds will be given for late arrivals, early departures, or cleaning and maintenance concerns. If present and reported, all cleaning or maintenance concerns will be corrected promptly.
Check-in time begins after 4:00 P.M. Local Time. In some instances, access to your property may be unavoidably delayed due to cleaning or maintenance scheduling circumstances beyond our control. There will be no discounts, credit, or refunds offered due to a late check-in or delays in check-in. Your patience is appreciated in these circumstances. Early check-in may be available for an additional fee, but due to cleaning and inspection schedules (particularly during the summer season) will require special arrangements. If you arrive after office hours, please come to the office the following morning to check in and receive your parking passes.
Check-out time is no later than 10:00 A.M. Local Time. Late check-outs may be available in the slower season for an additional fee; however, it would require special advance arrangements. If you depart after 10:00 a.m. you may be subject to additional charges up to and including the full daily rental rate. Text “CHECKOUT” to 850-695-8582 upon your departure.
Family-Oriented Rentals Only! The person making the reservation must be 25 years of age or older and MUST occupy the rental property the entire term of the reservation. The person over the age of 25 who has reserved the unit will be held accountable for all persons who are under the age of 25. Any violators will be immediately evicted with forfeiture of all monies.
Responsible Renter. As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. You agree to be solely responsible for your actions and the actions of all family members, guests and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the terms.
Maximum Number of Guests. One-bedroom units – maximum four (4) guests. Two-bedroom units – maximum six (6) guests. Three-bedroom units – maximum eight (8) guests. If the maximum occupancy allowed is exceeded, this could result in immediate eviction and forfeiture of all monies
Parking Permit. All vehicles must have Parking Permits to be displayed in vehicle. Unauthorized vehicles may be towed at owner’s expense. Maximum of two (2) parking permits per unit. Recreational vehicles, including boats and trailers, etc. fitting within the boundaries of a single parking space will be allowed to park in designated areas only. Vehicles including motor homes, RV’s, vans, etc. are not to be occupied while on property. No oversized vehicles, motorhomes, boats, or trailers allowed. Parking is at your own risk. Please lock your vehicles.
Absolutely no Animals Allowed. Animals are not permitted in rental units. If evidence of an animal(s) is found in your unit or on the premises, you will be evicted immediately with no refund of rent. You will incur an additional charge for cleaning/damage if any evidence of a pet is found in the unit. You agree that prohibition on animals is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens. Service dogs are not considered pets and are allowed in accordance with Federal law. If you have a service dog accompanying you, please notify us at the time of booking so that we can get you our policy and procedures to make reasonable accommodation. Owners of service dogs will be financially responsible and liable for any/all damages, injury (including any injury to the service animal), and all extra cleaning, pest control, or replacement costs for furniture, fixtures, or equipment. Emotional Support animals are not service animals and do not have the same rights. False claiming of Service Animals is a crime under Florida Statute and is a misdemeanor with penalty of a fine and community service.
Methods of Payment We accept Visa, MasterCard, and Discover credit cards. Other acceptable methods of payment greater than 30 days from check in include personal check, cashier’s check, certified check, and money order. A credit card will be required at check-in for damage to the Rental Unit.
Travel Protection Insurance We have partnered with Generali Global Assistance Travel Protection to provide coverage for our guests. Generali provides cancellation and interruption services as well as emergency assistance and travel services. The travel insurance is optional, and the cost is 6.95% of your total reservation stay. (Rates are subject to change without notice). We strongly recommend coverage. To learn more about CSA please visit www.vacationrentalinsurance.com. The travel insurance protection, if purchased, provides reimbursement for unused, nonrefundable payments if your trip must be canceled for a covered reason. By way of example only, covered reasons include: mandatory hurricane evacuations, sickness, injury or death, armed service revocation, involuntary termination of employment or other specific reasons listed in the travel insurance policy. For coverage inquiries guests should call (866) 999-4018. The travel insurance premium is nonrefundable. You may also purchase travel insurance from a third party – there are even some policies available that are CFAR (cancel for any reason).
Cleaning Fee. We require a one-time departure cleaning fee to be paid by the guest to cover the cost of normal cleaning. Rates are subject to change without notice. All units are subject to a departure clean based upon size of a unit. A one-bedroom unit is $189 plus tax, a two-bedroom standard is $199 plus tax, a two-bedroom penthouse is $209 plus tax and a three bedroom is $209 plus tax. Rates are subject to change. This fee is included in the total for your reservation.
No Daily Maid Service. Your unit will be cleaned to quality standards prior to your arrival. Guests are responsible for cleaning the unit during their stay and for leaving the unit in good condition at checkout. Please maintain the cleanliness as if it were your own. If your unit is found abnormally dirty at checkout, you may be subject to additional cleaning charges. UPON ARRIVAL, IF YOU HAVE HOUSEKEEPING ISSUES OR PROBLEMS, PLEASE REPORT THESE ISSUES TO THE OFFICE SO THAT WE MAY PROMPTLY ADDRESS ANY HOUSEKEEPING ISSUES. NO DISCOUNT, CREDIT, AND NO REFUND WILL GIVEN DUE TO HOUSEKEEPING ISSUES. No use of spray or gel tan products that can rub off on sheets, etc., nor of glitter, or hair dye. You will be charged for damaged items such as sheets, furnishings, etc. and/or an additional cleaning fee.
Supplies Provided in Your Rental. While linens and bath and beach towels are included in the unit, daily maid service is not included in the rental rate. The Rental Unit will be stocked with an initial supply of trash liners (1 per trash can), toilet paper (1 per toilet), paper towels (1) , bath soap (1 per sink), laundry pods (2) and dishwasher pods (2). Extra items needed are your responsibility to purchase or bring. Guests will need to provide their own paper items and cleaning supplies as well as any spices, condiments, coffee filters, dishwasher tablets and laundry detergent as well as other food items desired. Guests will also need to supply their own toiletries. A standard drip coffee maker is provided. The initial supply of towels includes 4 of each for 1-bedroom units, 6 of each for 2-bedroom units and 8 of each for 3-bedroom units. All our units do include a washer and dryer for your convenience.
Association Registration Fee: A mandatory $25 Association Guest Registration Fee is required for all paying guests. This fee has already been included in your total reservation amount. Completion of the Guest Registration Form located at the bottom of this agreement is also required prior to arrival.
Third Party Fees. Service fees may apply to guests who reserve online with third party booking websites such as VRBO, Homeaway, etc. Third party service fees are neither controlled nor collected by us, and as such are not reflected on reservation statements provided by us.
Furnishings. All units are privately owned. Décor, colors, furnishings, and inventory may change and vary from home to home. However, all units will provide the same general features, such as a fully equipped kitchen, washer and dryer, drip coffeemaker, dishwasher, refrigerator, stove/oven, microwave oven, blender, iron, central heat and air conditioning, and televisions. Please do not rearrange the furniture. Please do not move items from one unit to another.
Owners’ Closets. Units may have one or more locked areas or closets that are reserved for the storage of the owner’s personal property and are not included in the use of the rental. Please respect these areas. Forcing open a locked owner’s closet is considered breaking and entering, and charges may be filed accordingly.
Entry to Property. Representatives of management or the owners may enter the unit at any time to make repairs or as needed to inspect and ensure the safekeeping of the property.
After Hours Lock Out. Our condos are equipped with electronic deadbolts that use an entry code. Also, there is an entry lever underneath. Do not lock the entry lever and then leave your unit as these require a key to enter. If you should be locked out of your unit after business hours, a lockout service is available. A lockout fee of $50 will apply.
Departure. Please leave the unit neat. Please place any dirty dishes in dishwasher and start. Trash is to be removed when you depart. The trash chute is by the south elevator (gulf front building) on each floor. All trash must be bagged. Units left with dirty dishes and garbage will be subject to an extra cleaning fee.
Maintenance or Housekeeping Issues. During your stay, please promptly report upon discovery any maintenance or housekeeping problems. Staff may enter the property to respond to any maintenance and/or housekeeping issue(s) during your stay without prior notification. You agree to give us a reasonable amount of time to respond to your report and to cooperate with our efforts to address the concern or provide a remedy. No refund or rate adjustment will be made for unforeseen maintenance issues or system failures.
Utilities/Internet. No compensation will be given for the temporary outage of electricity, water, cable, or internet. As these are provided by third parties, we cannot guarantee service. Outages will be reported immediately, and all efforts will be made to have them restored as soon as possible.
Swimming Pool. Hours are from 9 a.m. until 10 p.m. No glass or food is allowed in the pool area. Posted rules must be followed. No lifeguards or safety personnel are provided.
You agree that any use of the swimming pool is at your own risk, and you agree to assume all risk of harm, injury (including death), and/or loss to persons or property resulting from use of such swimming pool. Further, you agree to indemnify, defend and hold Nautilus and the property owner harmless from and against all cost, expense, liability, damage, injury (including death) and all other causes of action whatsoever arising from or related to use of the swimming pool by you or your invitees, licensees, guests, family members, agents, permittees, or other persons using the pool during your stay.
Beach Service Complimentary beach service is provided on paid reservations of 14 days or less on a seasonal basis (March 1st to October 31st). It includes two (2) chairs and one (1) umbrella subject to weather permitting. If you need additional chairs the beach attendant can assist with that rental. Our beach service is contracted with Sunset Beach Service. For more information: www.sunsetbeachservice.com. Please be respectful, improper behavior to the beach attendant could result in refusal of this service with no prior warning.
Smoking Policy. No smoking, including vaping and e-cigarettes, is allowed in our Rental Units. Violators may be evicted, and all prepaid rents may be forfeited. Violators will also be charged a minimum of $250 for cleaning and deodorizing if any evidence of smoking is found. Smoking is permitted outdoors only – if on your patio you must close all sliding glass doors and windows. All cigarette butts and smoking debris must be disposed of appropriately. Marijuana smoking is strictly prohibited.
Balconies. Hanging any items from balconies or windows is strictly prohibited. Throwing anything off balconies, windows, or from a higher floor of any building is a CRIMINAL OFFENSE. No dumping of ice/water from chests/coolers from balconies or walkways. Violators will be fully prosecuted and will be subject to immediate eviction with no refund. A clean up fee of $250 will be charged.
Trash. Trash must be deposited in the dumpster in the trash room on the 1st floor. There are trash chutes on each floor across from the south elevators for your convenience. Leaving trash in the parking lot, walkways, corridors, elevators, stairways is strictly prohibited. Please do not litter; trash containers are located throughout the complex.
Damage Security Agreement and Authorization. Guest understands and consents to the use by Nautilus of the credit card Guest has provided (hereinafter “the Credit Card”) without necessity for original signature on the charge slip, the facsimile, copy and/or an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental unit is vacated. Guest expressly authorizes Nautilus to charge to the Credit Card such amounts as may be necessary to pay for the cost and expenses for any and all repairs and replacements due to damage to the Rental Unit and/or the Premises caused as a result of any act of negligence, carelessness and/or intentional acts committed by Guest and/or by any person occupying the Rental Unit during Rental Term.
Reporting Damage. Please note any damage to the Rental Unit upon your arrival and report it immediately to our office to avoid possible liability. You shall be responsible for all damage to the Rental Unit. Each unit is inspected upon departure, if unreported loss or damage is discovered after your stay, we will charge your Credit Card.
Sliding Glass Doors and Windows/Strong Wind Drafts and Air Conditioning. You are advised to close all balcony doors before opening the front door to avoid potential serious injury. Strong winds or drafts may cause the front door to shut unexpectedly and forcefully. Do not open the front door while any balcony doors are open even in the slightest. You accept and assume all liability for injury or death and any property damage caused by strong winds and drafts occurring in the unit.
Also, if you have sliding glass doors or windows open, please ensure that the air conditioner/heater is turned off. Use of the air conditioner with them open can cause the unit to malfunction and you may be liable for repair. Some unit owners have sensors that automatically turn off the air conditioner/heater if the sliding glass door is kept open. Also, keeping the sliding glass doors and windows open invites Florida insects into your unit.
Good Neighbor Conduct. Quiet Hours are from 10:00 p.m. until 9 a.m. Parents are responsible for supervising their Children. Loud, unruly or abusive behavior, visible intoxication, lewd and/or lascivious conduct, theft, fighting or quarreling with others, nudity including but not limited to women’s breasts, offensive language and running along the walkways and pool area are prohibited. Please treat the Property with the same care you would use with your own residence. Ball tossing, Frisbees, playing or running on or in the parking lot, walkways, corridors, elevators, lobby, stairways is not permitted and the use of roller skates, roller blades, skate boards, scooters, hover boards, or fireworks on association property is prohibited. No playing music at a level that guests in other units can be disturbed at any time of day.
No Social Functions/Parties Allowed on the Property. No parties, groups, gatherings, events or other social functions are allowed. Upon a violation of this term guest understands they are subject to immediate eviction with no refund. A party is defined as a gathering that exceeds the occupancy limit for the property by more than 4 persons.
Land Line Phones are Not Provided. If you need to call 911, please be prepared to give the name and address to the authorities– Nautilus Condos – 660 Nautilus Ct.
Outdoor Cooking. No outdoor cooking on balconies, walkways, or parking lot. An area with barbeque grills is located on the ground floor.
Beach/Sand Dunes. Please help keep our beaches beautiful. Walking on the sand dune is strictly prohibited. Please only use our walkover to the beach. If you are physically limited – there is public access next door that has a handicapped ramp to the beach. Please leave nothing but your footprints behind. No glass allowed on the beach. Underage drinking will get you arrested.
Balcony Railings. Nothing may be placed on balcony railings. No climbing on the railings.
Drugs/Controlled Substances. Any person occupying the Rental Unit during Rental Term who is found using controlled substances or allows others to use controlled substances, illegal drugs on the Premises will be immediately denied continued occupancy at the Premises. Smoking marijuana is strictly prohibited.
Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.
Substitution of Property. While we make reasonable efforts to honor your original booking assignment, we reserve the right to change unit assignments as circumstances dictate. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. We reserve the right to substitute a comparable property. If comparable accommodation is not available, you will have the option (1) to select from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. We will not be responsible for any other expenses or indirect costs resulting from unavailability.
Advance Reservations. We accept reservations up to one (1) year in advance. We can confirm reservations for a future date, but we cannot confirm or guarantee rates for dates beyond the current published rental rates.
Subletting. No subletting is allowed. The Rental Unit and/or reservation, or any rights arising under a reservation cannot be assigned, transferred, or sublet. Your reservation is not assignable or transferable to any other party, and any attempt to do so will be null and Void, and result in immediate cancellation of the reservation and forfeiture of all rental payments, deposits, and fees. The person listed on the reservation must occupy the unit the entire reservation. No refunds will be given.
Falsified Reservation. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental payment and the party will not be permitted to check in.
Rules and Regulations. All guests are required to conform to all the rules and regulations which are provided. Guests are subject to eviction, according to Florida Statute 509.141 with all monies lost.
Construction: Nautilus cannot predict or control construction activity in or around the property. We are not responsible for any inconvenience, noise, or disruption related to nearby construction, and no refunds or compensation will be issued for such occurrences. Please note that Association and owner construction is more common during the slower season (November–February), and our reduced rates during this period reflect that possibility.
Personal Items. You bear full responsibility for your personal items damage including damage from fire, water, theft or any cause – we recommend that you have personal property coverage insurance. for your Management will not be held responsible for acts of theft, vandalism, or other damage to the guest’s personal items left in the unit, nor their vehicle. Please lock your unit when departing. Please make sure your vehicle is locked at all times. Neither management nor the owner is responsible for personal items left on the premises by guests upon departure. If you wish to have them returned, you will assume the cost of shipping as well as a charge for the labor to have the item shipped.
Rates. Published rental rates are subject to change without notice. We expressly reserve the right to correct rates that may have been misquoted due to human error, negligence, or computer error.
Property Surveillance. Nautilus has a security system that includes surveillance cameras that may record your activities. Some properties have video doorbells that record your activities in audio and video. Guests consent to the presence of these recording devices.
Agent for Owner. We serve as the agent for the owner of the rental unit.
Liability. Guest agrees to indemnify and save Nautilus, its officers, directors, management, employees, and agents, as well as Property Owner, harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the Premises by the Guest, tenants or guests or from any carelessness, neglect or improper conduct of any persons entering, occupying or visiting the Premises.
Acknowledgment of Inherent Risks. You acknowledge that your use of the Property and its amenities may carry inherent risk, including risk of bodily injury, illness or disease, disability, or death. Being a beach property has risks including but not limited to: slippery floors and stairs, especially when wet, balconies with space between rails, clean/clear heavy sliding glass doors, and dangerous stairs or pathways. You acknowledge that bathrooms, showers, tubs, and tile floors may become slippery when wet, creating an inherent risk of slips, trips, and falls. This includes, but is not limited to wet or damp bathroom floors, slippery tub and shower surfaces, step‑over tub entries, condensation from showers or humidity, water tracked from the shower or tub onto tile flooring, residual sand or moisture from beach use
Guests are expected to use caution at all times, including using provided bath mats and non‑slip mats available in the bathroom cabinets, fully drying floors after bathing, and supervising children or individuals who may require assistance.
Therefore, each guest agrees that he/she is voluntarily participating in all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this property, you acknowledge that in all events and circumstances, Nautilus Community Association Inc and its employees shall not be liable.
Notice.
I, the undersigned hereby agree to the terms and conditions of this Rental Agreement and warrant that I have read, understand, and agree to the terms and conditions herein. I agree to abide by the restrictions on use of said Property. I further understand and represent that I am executing this Agreement on behalf of all parties, my Guest and any of their invitees.
I agree that this is a legally binding document and I have read all terms and conditions in this document. Responsible Guest signing this Agreement agrees to have informed consent of all members of Guest’s party and their invitees to be bound by the terms of this Agreement. I am agreeing to sign this Rental Agreement electronically.
Requirement for Check In.
You must have read the rental agreement and be prepared to sign it once you arrive. You will NOT be allowed to receive your door code and parking pass at check-in until you have signed and acknowledge these Rental Policies. Your continuing your reservation after receipt of policies acknowledges your agreement to these rental policies. IMPORTANT: FAILURE TO SIGN OUR RENTAL POLICIES ACKNOWLEDMENT WILL RESULT IN YOUR DEFAULT UNDER YOUR RENTAL AGREEMENT; FOREFEITURE OF ALL MONEY PAID (AS LIQUIDATED DAMAGES); AND LOSS OF YOUR RENTAL ACCOMODATION WITHOUT REFUND.
